A group of supposedly posted Bulgarian workers were subject of enforcement action. The Gangmaster concerned (Todorov & Co) claimed that the workers were posted from Bulgaria. The GLA inspectors found a number of breaches of their regulations, including a 16% deduction from wages made by the employer, threats to withhold wages, and employment of workers not entitled to work in UK.
All the Todorov workers concerned returned to Bulgaria, where some took proceedings for unpaid wages, the outcome of which we were unable to establish. No proceedings were launched in UK, partly because the Bulgarian workers’ status in the country was not clear if they were not genuinely posted, but in any case they were not entitled to work.
